    marie thank you for your`e advice,my husband has overstayed,in 1 reply you said he will be deported,then you give a second reply saying that because i am a usc his overstay will be pardoned.
    could you please clarify which one is correct.
    he has not got any criminal records.

      Marraige to a USC cures unlawful presence. He will be eligible for an Adjustment of Status. Do this before the law changes.

        Ok what I probably said was:

        once you file his overstay is pardonned.

        if you don't file and somehow he gets stopped for something by the cops or whatever and they find out he is out of status, they will deport him.

        He is deportable until you file that paperwork..after that he can stay while they process his application and either approve it or accept it.
