H1B Transfer Help

  • H1B Transfer Help

    I have an H-1B valid till August 2005.

    I left working with Employer A (the original petitioner) in July 2002, and started working for Employer B.

    Employer B never filed to have the H1B transfered over to them (should have been no problem since the job roles are very similar).

    The special registration brought up the issue - and now from what I understand that the "unwritten rule" of transferability of H1B is maximum 30-60 days.

    What options do I have? I can apply for a new H1B, or apply to transfer the old one. In either case, I am guessing I will be in trouble with special registration? Any opinions wil be appreciated. Thanks.

      So much is uncertain with Special Registration. The law does not give a window in which to file the transfer, but sooner is always better than later. File the transfer now, so an argument can be made that you are here legally.

      If it is denied, you can file for a new H-1B.
