    This is for a friend of mine.

    He has been out of status for almost 6 months now and married a USC 2 months ago.

    He didnt file his AOS yet because his wife doesnt have her birth certificate on hand and he didnt know where to start.

    She ordered a new birth certificate, but it takes 10 working days to get it.

    I know that he can send the AOS package now and the birthcertificate later..but my question is :

    If the birth certificate arrives at BCIS 15 days after they received the FORMS and FEES, what date will the unlawfull presence stop?

    Is it when the BCIS gets the FORMS and FEES (even if some documents are missing) or is it when the package is COMPLETE???

      Here comes a silly question: Why doesn't einstein just wait until he gets the birth certificate?? In my experience with the INS, it's never been a good idea to send them a half baked package.

        Silly question?

        When dealing with the BCIS, one day can make a big difference, thats why.

        This guy is just trying to avoid being unlawfull for 180 days or more.

        If he wanted to travel outside the USA while his AOS is pending he would be barred from re-entry for 3 years.

          out of status for 6 months?so whats the diffrence if he waits 10 day or 15 days or 1 month.If he was out of atatus with a legal entry and later married it would no t make any sense sending in an incomplte application,this would rather lengthen the process.

            If he wants to use Advance Parole while his AOS is pending, there could be a big difference.

            If he file after 180 days, and he has an emergency travel to make, he wont be able to come back for 3 years right? Even if he is married to US Citizen.

            But if he has less than 180 days of unlawfull presence and uses AP he wont have a 3 year bar.

            Unless what I say is wrong???

              Everybody doesn't have the chance to own his personal computer.

              There is nothing on this site stating that 2 different people cannot share the same computer to ask a question. Or stating that one person is not allowed to ask a question for a friend.

              If you are so smart, why don't you answer the question instead of acting like child.
