  • CSS-Newman class members living abroad or whose applications deemed abandoned

    Class counsel in the CSS and LULAC-Newman cases are preparing a class-wide motion to enforce the settlements in those cases on behalf of the following class members:

    1) Class members denied class membership or legalization because they are now living abroad (including those who could not attend an interview because they now live abroad).

    2) Class members whose legalization applications CIS denied as "abandoned" because the class member failed to respond (or respond adequately or timely) to a notice of intent to deny (NOID) or request for additional evidence (RFE).

    CSS and Newman class members in these categories are encouraged to contact Wendy Hernandez at the Center for Human Rights and Constitutional Law, whernandez@centerforhumanrights.org.

              It’s tough for me to decide whether it would be better to file a lawsuit against the USCIS for not adhering to the settlement agreements, of your infamous class action case. Or to file a lawsuit against you, and your slick buddy Peter Schey, for getting many of us into a catastrophic mess and abandoning us while the ship sank. You did not stick around long enough to discover that the settlement agreement was NOT followed. In fact it was spat on by the arrogant and rouge USCIS.

              I myself had 4 scheduled interviews, with 3 different immigration officers. All these interrogations were not to find out if I qualified for legalization, they were to find a way to deny my petition. When no legitimate reason could be found. They made up a false reasons, then denied me for them. Where were you Carlos, sun tanning at the beach or fatting up at the buffet?

                  What a load of B.S. So, the lawyers want to act on behalf of people who weren't even supposed to be in America and have now left America? This is absurd!!

                  When will you guys realize that illegal is illegal?

                      Two of my friends got deported by ICE after their LIFE amnesty application denied by USCIS…and both of them does not have any criminal record what so ever…they only had been living and working illegally in the U.S.
                      When ICE agent arrest them and put them in jail they asked each them to pay bail bond $20,000.00 cash but because they don’t have money and they don’t want to stay in jail forever they asked for volunteer departure and they left the county! They lost all the taxes they paid for their social security for the past 28 years, what injustices!!

                        I know that you’re too important to read this, let alone answer. But just in case, there is more you should know.

                        I know that it is not possible for you to personally help everybody. What I’m criticizing is the actual settlement being so vague about standards, you failed to include basic fairness guidelines. Much of these decisions are at the digression of the officer. This invites foul play, and favoritism. Also little thought went into what happens if denied? No provisions were made for the denied.

                        Furthermore, there was no guidance or advice posted on your human rights website. For example, there were no warnings that the main function of the USCIS is to keep foreigners out of the USA at any cost.

                        We were not warned that if we were to attend an interview without representation, that it would be possible for a USCIS officer to claim that you confessed violations while in his/her presence that would render you inadmissible, and that he/she need not produce any proof of the alleged violation that will get you into handcuffs. The false violation need not even make any sense, or even be realistic. The officer's word is more indisputable than the word of God.

                          Question to CSS/LULAC class member if the case denied and it know pending in front the AAO in Washington, are we still eligible for work authorization?

                          My case still pending and for the last two years I applied to renew my work permit and I paid the $340 renewal fee, the USCIS take my money but refused to renew my work permit, is this legal!!

                            Yes you are,you must call and find out what happen if you never got you work permit you should get you money back or at least a letter from them.

                              The original settlement agreement clearly states that the USCIS will renew the EAD’s of all CSS/Newman/LULAC class members FREE OF CHARGE, while there cases are being decided, even while in an appeal. I think you all already know that the USCIS does not follow the law.

                              This is yet another area where Carlos and Peter have dropped the ball and let us all down. Really, the class action suit should be against them. Many lives have been ruined because their negligence and lack of interest. I know their original intentions were good, but they needed to follow through. As you will all notice Carlos has not written back, this is because he does not care. He got his money. That’s all.

                              The fact that the USCIS knows that Carlos and Peter are no longer interested and will not protect us. Gives the USCIS the green light to break the law, and violate the few rights that we have. Why not, nobody's watching, and nobody cares. Nobody is policing the police.
