      the petitioning entity is to show proof that it is capable of paying the h1-b beneficiary. The business could be new as long as their is enough money. However, this is always a case to case basis. They might want or require the business to show profitability so they might question the eistence.

      The job should require a bachelors to get an H1-b

        It is possible to sponsor H1 as a scilful worker for your restaurant, but that person should be able to show a proof of certificate for that kind of job. For example if your restaurant is specialised in Mediterenean cooking you can hire an H1 Mediteranean chef. The person needs to have experence in that field and some certificate for that.good luck!

          Sure, a new entity can sponsor an H-1B petition so long as it shows an ability to pay the prevailing wage as determined by the Department of Labor. This can be demonstrated in a number of ways. Just be sure the position requires a bachelor's degree or the equivalent thereof.
