  • Non immigrant visa refused because of pending I-130,need help

please i need your help or directions in securing a non immigrant visa for my husband to attend my boot camp graduation ceremony. i filed I-130 for him last year december with my permanent residence status. He applied for a non immigrant visa in May this year but he was denied because I-130 is already pending and filed for him. i'm joining the Military and going to boot camp couple of days to come, we re looking at him re-applying by November this year for a non immigrant visa again but this time with an invitation to attend my boot camp graduation ceremony and hopefully he will return after the ceremony, my question please is if he has an invitation to attend my graduation ceremony from BMT (basic military training) does he stand a chance of non immigrant visa being granted to him????? really wishing he will be there. thanks i anticipate your advice

The COs do not care why a person wants to GO to the US; they are only interested as to why they will LEAVE the US...with an LPR spouse, what is he going to say? "Gee, I promise I will return..."...now that's helpful. Nor will your status as a brand new private or seaman apprentice mean anything...you have already filed the I 130 - now it will look like he wants to find a way to avoid the 2 year (approximate) wait time for the petition to be current...
