  • Changing DOB on a green card

I am the Guardian ad Litem for a youth in foster care whose green card has an incorrect birth date. We have been told that it will take 6-12 months to get it corrected, but she will turn 18 soon and will need the green card to get a job. While she waits for the change to be processed, will she be able to work? And will it really take that long?

sure, she can work. she is a permanent resident - the incorrect green card doesn't change that. but you should receive an i-797 notice of action after filing i-90 to replace the card. once hired she should use the existing green card and explain the typo/mistake. use the i-797 as proof it is being fixed. i'm assuming you have a birth certificate or something else to show age in the meantime.
