  • I-751 denied

    Hi,
    and thank you in advance for any help i can get. I just received a letter from uscis saying that my wife's I-751 was denied. They said that they mailed a letter to us requesting evidence and that we did not respond on time. the problem is we never got the letter. Now the petition is considered abandoned and was denied. The letter says that i can file a motion to reopen a petition. The form they want me to file is 1-290B. Now what should i write in the form as a explanation, is there another way to just tell them that i never received the letter.

    I have called them couple times in the past and it was never mentioned to me that a letter was sent or anything like that. Please help and let me know if more explanation is needed. I just requested an appointment with an immigration officer on Wednesday.

    You need to file the form with filing fees and explanation on the form and recommened as a separate letter stating she never got the form. Maybe she can write an affidavit swearing she never received any correspondence. If you remember the dates you called USCIS, you should mention that as well.

    If you want to really be sure you get this right, you might want to get an immigration attorney to assist you.

      Hi,

      You can speak to an immigration lawyer and you can pay fees prescribed by USCIS.
