  • Married end time in US 1st time in my home country with diff. woman?

    Are there conflicts when we change status to green card here in U.S.?
    My marriage with my first wife in my home country is not annulled but we are not living together for so many years. Found somebodyhere in US decided to marry again we got married a year ago. Can INS trace my first marriage even if it was solemnized not in US territory?
    Can we be granted green cards?
    Please help! What to do? Is this grounds for deportation even if at present I am dependent to my 2nd wife on H1B status?

      did you file divorce here for your first wife who is not here?
      since you are on H4,the second wife is only on H1B right? and so she is not LPR or citizen and therefore you are in big trouble and greencard is out of the question.Of course INS will check your
      marriage papers abroad.

        Are there options in my case?
        Can a Lawyer help?
        Does it mean I'm not a legal H4 then?
        Does this situation I'm into makes me a candidate for deportation if found by the INS?

          PLease answer the questions first.Is your wife on an H1B and did she file H4 for you or are you just assuming you are on H ?
          I don't want to sound moralizing here but is the marriage for convenience or in one way or another did you inform your first wife of your plan?

            Hey Ron
            the INS will not know of your previous marriage(unless u have already told them) as long as it was not in the US/Canada.Don't get worried.As long as ur H4 is valid(assuming ur wifes H1 is ) you should not have a problem.As far as GC is concerned it depends on your wife's H1 sponsors and the lawyers involved.
