    Can one fill for citizenship if one has no income tax return? Makes a living by selling on ebay but H and R block says it cannot be used to fill income tax. Any info will be appreciated.

      Why would H & R Block not consider that you earn income? It makes no sense. I suspect what they mean is that, in essence, you are self-employed, and therefore should declare your revenues from Ebay on a Schedule C. Deduct any costs you incur through the auction process and determine the net profit of the business. This figure would then be recorded as income on your 1040. Of course, if this is the case, you will be subjected to self employment tax (figured on Schedule SE)

      Anyone else have an idea? Maybe you should address your post to 4now.....he's the "tax guru" here.

            Part 10 of the N-400 states:

            A. General Questions
            5. Do you owe any Federal, state, or local taxes that are overdue?

            If you answer "Yes" to any of these questions, include a written explanation with this form. Your written explanation should (1) explain why your answer was "Yes," and (2) provide any additional information that helps to explain your answer.


            In addition, A Guide to Naturalization states:

            "If you have ever failed to file an income tax return since you became a Permanent Resident, send:

            All correspondence with the Internal Revenue Service (IRS) regarding your failure to file.

            If you have any federal, state, or local taxes that are overdue, send:

            A signed agreement from the IRS or state or local tax office showing that you have filed a tax return and arranged to pay the
            taxes you owe; AND

            Documentation from the IRS or state or local tax office showing the current status of your repayment program."

                John Doe--You're wrong about "as long as it's legal". You're expected to report illegal earnings as well (though I suppose you wouldn't call them that). That's how Al Capone got brought down--not for killing people but for income tax evasion.

                  You're supposed to report income from illegal activities (even if you don't specify it as "illegal"). You're right--people who earn illegal income wouldn't report it, which is precisely what gets them into trouble. (Illegal aliens work illegally, but some actually do report it using numbers created especially for the purpose.)

                    What about if some one had not worked for one ,and was eating his savings with out taking unemployment check?
