    A friend (honest!) has just informed her immigrant husband (they have been married for 2 years and he has been in the country legally for 17) that she wants a divorce and has left their residence. This is, unfortunately, on the heels of their sending in paperwork for his permanant residency green card by marriage. The simple question is - does she need to notify the INS of anything to protect her from any semblence of fraud, etc.?

      Your "friend" (right) should imediately complete the divorce. Better yet, if possible file for an annullment based on (his) fraud. furthermore, she should sue as part of the divorce/annullment or under a seperate action for any money that he got plus for intentional infiliction of emotional harm. Once they have these judgments in hand, they should draft a well written statement to USCIS (Not INS anymore) informing them of the circumstances. They should send to the local office as well as the regional processing center.
