    when an applicant to adjust status is waiting for his interview and thus his application is pending, shouldn't this period of time constitute as lawful residence or evidence of nonimmigrant status?

      The applicant has not been granted lawful permanent residence yet. There are no guarantees he/she will be granted the status during the interview.

        Thanks, I understand there are no guarantees. I was wondering whether there are any extenuating circumstances where the petitioner could be deemed in lawful status mode when the UCIS rejects a petition to adjust status b/c it deemed the petitioner to be in an unlawful status during the time the petitioner was waiting for an interview...

          It is lawful residence till the interview day.
