  • U.S Citizen Mother petitioning overstayed son

    If a U.S Citizen Mother petitioned her unmarried son over 21 back in 2005 but the son overstayed his visa and he still live in the U.S will he be able to adjust his case in the U.S when the priority date became current?

    Anybody went through this process? did it work or the USCIS denied the application because the person overstayed his visa?

      Pattal: No, you will NOT be able to adjust your status in America once the priority date becomes current. Furthermore, because you overstayed your visa, you will NOT be able to obtain an immigrant visa at the American Embassy in your country of origin.

      I realize that the decision to overstay your visa seemed soooo easy at the time...but, now...well, you're basically screwed.
