  • Finace Visa

Thanks for the input on the previous post. You say its easy to file the finace' visa without a lawyer, but after the marrige in the US will we then have to apply for some other type of visa in order for him to stay in the US? Also during that time can he work or not? And if so then does he have to apply for antoher type of working Visa? What is the time it takes also for the finace' visa? Is it a a long time to get it approved or is it something that can take months? years?

Hey Kathy, a fiance visa will only take a few months but it really depends where he's from. I looked for your post and can't find it.

This is the way it works:

He gets a fiance visa, comes to the US, you get married and then you can apply for an Adjustment of status. He'll get a work permit that allows him to stay and work while his petition is pending.

      This will answer everything:

      ~ Fiance visa:
      http://www.ins.usdoj.gov/graphics/howdoi/fiance.htm

      Application proceedures:
      http://www.ins.usdoj.gov/graphics/howdoi/fianceapp.htm

      ~ AOS:

      http://www.ins.usdoj.gov/graphics/howdoi/legpermres.htm

      AOS forms to file:
      http://www.ins.usdoj.gov/graphics/ho...pplication.htm

Read over those carefully and it will probably clarify a lot.

I knew I had read it but I couldn't find it! I'm really tired today.

The INS site is actually really helpful once you find what you need.
