    Can a US citizen petition for son 25 years old, unmarried, who is out-of-status? I-130(originally filed when petitioner was permanent resident) is approved and priority date is May 12, 2007. Also, son has RN license.

      First of all, please edit your post title to include "Immigration Law Question", to ensure you only get relevant answers.

      A new petition does not need to be filed. The current one can be upgraded by writing to the USCIS with a copy of the petitioners naturalization certificate.

      Depending on the country of origin, there will still be a bit of a wait.
