  • some advice needed!

I am a American citizen and My finacee entered the USA in July of this year with a h2-b visa for work which expires on November 30th 2005,since he has arrived he has been fired from his job and also I have asked him to marry me.After we get married will we have any problems if we dont file his papers before his visa expires? His visa expires in about 3 months and were unsure at how long the process is going to take to switch his status. What papers will we need to start the process after we get married? What are the most important papers we need to file first? Can any papers wait?

You will have to look into I130 and I485. Do a search in this forum, you will find what you are looking for as many cases deal with your situation.

Working with another job with his specific H visa is not advisable.

Once you marry you will need to file the I-130. You can also file the I-485 and I-785 (not sure if that's the right number), but it's authorization to work at the same time. Your boyfriend/husband may be able to get the authorization to work before his H2-B expires. If he doesn't, I read in the past that you can go to a local office with proof that you have applied, i.e. notice of receipt and he should be able to get the EAD to work then. Good luck!
