  • N-400 question: Help Please

    Hi:

Both me and my got our GC on the same day. We qualify for N-400 next month, however, she may need to go overseas (when and for how long not known at this time). So, my question is can I apply for USC without her applying? Does that gonna raise any question within INS?

    Thanks

Applying for citizenship is a personal choice and not mandatory.

You may apply individually and it won't raise suspicion.

        tomhu,

don't forget that if she goes overseas for too long she may be considered to have abandoned her permanent resident status.

Before she travel she should file Form 470,
She can travel oversas, and before she fly get the permit to re enter United States from Immigration. (AKA Travel Document)issued by the immigration I for got the form # That will allow her to stay out of US according to date printed on the permit. Just come back one month before it expires.
