  • Discrepancies in V Visa

    Hi all,

To reunite children with their parents is the policy of natural justice and equity. In view of this, the former President Bill Clinton signed the bill the LIFE Act of 2000 into law creating a new visa category, the "V" visa, which has allowed the children of F2A category, who have been separating from their parents for more than 3 years. This act of the United States is very praiseworthy. But, the children of F2B category, who have been separating from their parents for 9 years, have been debarred from taking the advantage of this newly created V visa. With this, it is certain that justice is not done to them. It is astonishing to say that how the U.S. legislators have ignored the children of the F2b category who have been separating from their parents for almost a decade, when creating the V visa. This is to draw the kind attention of the U.S. legislators to the hardships being suffered by both the children of the F2B category and their parents. Therefore, this is my humble request to the U.S. legislators to amend the LIFE Act of 2000 entitling the children of the F2B category also for the "V" visa so that they could join their parents.

The key word here is "children". Although the F2B category is listed as unmarried "children" over age 21 of LPRs, a more accurate title would be unmarried "adult offspring" of LPRs. There is a big difference between a 35 year old man and a 6 year old boy. F2Bs have other options, such as DV and employment, which are not available to minors.

        Amul,

I am too at a loss to understand why the congressmen make the laws but never take care about the F2B category.Latest they have made CSPA but not made it retroactive.According to the new law all children form now onwards will get the visa with their parents even if they are above 21 years,as their age would get frozen when their parents and them as beneficieries have htier applications approved.
But the sadest part is that those people who have been waiting since 1996-97 are not bothered about.Waht mistake had they committed ,that they have not been covered under this act.As i understand they would have been very less cases to ahve bbe waiting since long without getting married.Ideally they should have given preferance to all such people waiting and given the visas and hten should have treated the new cases.

I am totally at a loss to understand the way these people think............

                  Amul,
                  Don't worry for those children.

                  Just have some patience!
In the next 20 to 40 years these issues will be addressed and solved
It is all a matter of patience
Hopefully parents don't die before LIFE ACT of 2000 amended (or LIFE ACT 2040 introduced) and those "children" become eligible for it.

                  Good luck
