  • Visitor visa with pending I-130

    I got married 2years ago and my hubby became citizen of u.s last year he has filled my case on green card and upgrade it a year before but my i-130 is still pending can I apply for a visitor visa?

    You can apply, but it will be denied.

      you can try applying for a fiance visa which will allow you to travel to the US while waiting for the I-130 to process. you will not be permitted to work while in the US on the fiance visa

        Raha, you are totally wrong! She is married. Her husbandcannot file a Fiancé petition. If a person came to the US on a Fiancé visahe/she CAN file I-765 and obtain a work authorization.

        Manoo, call I-800 number of the CIS if you believe the I-130 Petition is out of processing times and place a request to expedite the case.
