    If the latest tax return is well above the poverty line but the previous two are not, would that be grounds for a denial?

      Most likely not, the most recent information is most determining. Last years and the current income the sponsor has.
      I am not a lawyer nor do I claim to be one so please double-check any information given by me, or anyone else for that matter, with a certified (immigration)lawyer before you take any further steps.

        Last year Tax return that what matters with current job letter or current pay stub, however if any question asked you can show enough bank balance to prove your case. If previous tax return is below poverty line by $5000 then

        Example for a household size of 4:
        125 percent of 2003 poverty guideline $23,000
        sponsor's income - $18,000
        Difference = $5,000
        Multiply by 5 x 5
        Minimum Required Cash Value of Assets( Bank Balance letter)= $25,000

          I FILED A JOINT RETURN WITH MY HUSBAND THIS YEAR, HIM USING AN ITIN. THE JOINT RETURN IS PLENTY OVER THE POVERTY LINE. MY INCOME ALONE IS NOT OVER THE LINE AS I'M A FULL TIME STUDENT AND ONLY WORK 30 HOURS A WEEK. I READ ON USCIS WEBSITE THAT THE SPONSORED ALIENS INCOME CAN BE INCLUDED. DO YOU THINK THAT IT WILL WORK?
