  • Can you answer this question for me?

If I withdraw my husband petition I-130 before it gets approve are there any possible ways of finding out his current status? I'm currently going through a messy divorce and have a Restraing Order on him due to his Domestic Violence. I'm in hiding and afraid and want him deported before he finds me.

    much is appreciated

On what basis did he come to the country? If you withdraw a petition before it is approved, unless he has extant status in another visa category, he would have no status. I'm not sure that it would mean immediate removal; he could choose to remain here without lawful status (many do) or attempt to gain it through other means.
The above is simply an opinion. Your mileage may vary. For immigration issues, please consult an immigration attorney.

        thx sappyconifer,
he's here on a student visa. Do you know how I can get information if any on his status case. I believe he is bringing his family or 'girlfriend' or perhaps abroad 'wife' to the
        U S one by one.
Can he do that without my consent or knowledge? What other visa category can he extend his status? How can I notify USCIS regarding his where abouts if he remains here unlawfully?

        thanks
