  • I-130 Question

    My husband is being detained for an in absentia. We have filed a motion to reopen the case, and waiting on the decision. Can an I-130 be filed while we are waiting on this decision? Or should one not be filed right now? I was also told today that we could not ask for a bond hearing until we hear the decision on the motion to reopen???

    There are some people that are getting upset that I am asking questions, but I thought that this forum was for asking questions. I just dont understand why all the agressiveness and ugliness..

      Please don't appologize for loving and wanting to protect your husband. If I can help, let me know. You should probably consult with an immigration lawyer on this subject. The laws very and sometimes our INS system doesn't tell you if you're doing the right thing or you're messing up your future plans with regard to INS

          Sorry, I don't really know the answer to that, but I can tell you two things:

          1) Don't hire an immigration attorney who is willing to sacrifice American citizens by committing fraud; and

          2) Don't hire an immigration who will accuse you of being an anti-Semite if you file a lawsuit against him/her for fraud (and yes, I am talking about Allen E. Kaye, Harvey Shapiro, Bernard Rostanski and Jack Gladstein. These liars will call you an anti-Semite if you file a complaint against them for fraud).

          One more thing: Anti-Semitism is deplorable but it is NOT illegal. The police cannnot arrest you for being an anti-Semite. Fraud, on the other hand, is illegal.
