  • CD1 and Fiance visas

I plan on getting married to my US fiance this Sept. We intend to file a petition for a fiance visa when I return to the UK next week. In the meantime I have been offered a job on board a cruise ship and I was wondering if anyone knew if it possible to have a CD1 visa and apply for a fiance visa at the same time?

      Hi Laurah and welcome,

I found a similar question on a different web site. Please take a look:

It appears a crewman is not eligible to adjust status in the USA, even if it is marriage to a USC. You should definitely consult with a reputable immigration attorney to determine the best path to take.

Good luck (and I am in envy of your potential job on the cruise ship - lol).

I think the CD-1 Visa will muddy the waters for a potential approval of the K-1 Visa. However, she should speak to an attorney since neither of us have those credentials.

I don't see a "visa conflict"... they are for different purposes. The same way one can go and visit USA on tourist visa while waiting for a fiance visa. This is just a "transit" visa..

However, if you are going to stay away from home country for an extended period of time, it may happen that you miss the communication from the embassy (package with instructions and interview). There is no way to tell how fast the process will go (3 to 10 months?), and I am not sure after what time the embassy will consider the petition abandoned if they don't hear from you... And even if you have someone collect your mail, I doubt you can just "jump" the ship and return home.
