  • QUESTION ABOUT APPLYING FOR THE RIGHT VISA

MY FIANCE LIVES IN COLOMBIA. WHAT I WOULD LIKE TO KNOW IS WHAT VISA WOULD GET HER HERE TO AMERICA THE QUICKEST OR DO THEY ALL WORK THE SAME. SHOULD I MARRY HER IN COLOMBIA AND APPLY FOR A NONIMMIGRANT VISA OR IMMIGRANT VISA OR SHOULD I APPLY FOR A FIANCE VISA AND MARRY HER HERE IN THE STATES. I WOULD APPRECIATE ANY HELP I CAN GET. I REALLY NEED THE ADVICE. ALSO WHICH VISA REQUIRES THE LEAST AMOUNT OF WORK TO APPLY FOR.

You should marry her in Colombia and apply for a CR-1 immigrant visa or you should apply for a K1 fiancée visa and marry her in the US.

Expenses and difficulty of the petitions and applications are very similar. Processing times vary by location and the current situation. The fiancée visa may get her to the US faster and save you a trip to South America, but take longer for her resident status and (eventually) citizenship. The K3 nonimmigrant spousal visa is not practical at this time.
