  • Priority date is 6/4/1993, Can he apply for PResident

    He is unmarried over 21 and mother is a citizen, can he apply for permanent resident? He keeps getting a letter from USCIS stating that priority date is not current? Can anyone tell me when he will be current? Thanks for all your help.

      The visa petition is only one portion of the adjustment of status equation. There are the factors of inadmissibility pursuant to INA 212. You should seek counsel to determine priority date currency and admissibility prior to engaging in any action with USCIS.

        My guess is he's from either Mexico or the Philippines, right?

        If Mexico, he has about another year. If Philippines, he has another 6 years.
