    I came to the U.S. with my 14 years old son last month. We entered with K-1 and K-2 visa(fiancee). Last Saturday I got married. My husband is an American citizen. I want to apply for adjustment of status now. They ask my husband for an affidavit of support in order to know if he is able to afford our expenses. The problem is that my husband filed bankruptcy the day before the wedding. Are they going to reject my husband as our sponsor? Are they going to deny my adjustment of status petion?
    I appreciate any help since I am very concerned.

      Hello and welcome. Your husband will need to meet the guidelines for the Affadavit of Support which can be found here.

            meeting the poverty lines is one of the requirement. NO they will not deny your petition, they will ask for the joint sponsor to meet the guidelines, if your husband cannot provide the joint sponsor then only your petition will be denied.
            You guys suppose to find joint sponsor who can file I 864 for you guys.
            Its a discussion, not a legal advise..

              Like Mohan said, you will not be denied on that basis alone, however if there is no evidence that someone will be able to support you as dependents then it will be denied.
              Always interested in the H1-B visa, the Eb-5 Visa Program and other Eb5 Investor Visa related issues.
