  • Adjustment of Status Question

    I've got a client who entered without inpsection in 1994 and was ordered deported in 1995.

    Since then, he has been granted an I-140 labor cert. He has filed two unsuccesful Motions to Reopen and an appeal that were all denied as untimely, but he's seeking to adjust status based on the labor cert, (which is more than 90 days old).

    Any suggestions?

        To be asking a question like that, my suggestion is that you resign your license. You have no business being a lawyer if you don't know an EWI can not adjust status - ever.

            WTF??? An ethically challenged "immigration" attorney who doesn't even know that his law breaking client, who has NO respect for US laws (and who has been working all these years without permission...another 'fact' this 'attorney' has conveniently overlooked), can't adjust status to some phony job (and why is this 'attorney' so willing to help some enemabag-cleaning illegal steal a job from a U.S. citizen??)..come on...tell your fellow citizens why you wish to sell them out....how much are you charging your EWI slimebag? As usual with immigration attorneys, it's all about the money.

              The only way for an EWI to adjust is by marriage to USC, suspension of removal, or asylum claim.

              Any of those apply?
