    Hello. I am currently employed as a HIB doing investigative work sor THE SSA. I am trying to have an attorney help me with the certification. I have a master's degree. The job I currently have is promoted to . The basic requirements for the initial job was a bachelor's. I am being promoted to another specialist position. This is the job for which I am requesting the perm. It does not require a master's. Is it true that this job is considered unskilled or "other" and that the certification could take years. Please advise. If this is not true, do you suggest I just find another attorney? Many thaniks. I have a meeting with this attorney and my job at 1:30 om today.

        Hi and thank you very much for considering to respond. Well, basically, the attorney met with my job and determined that the promotion would do no good if the job is not requiring a masters. Also I work for the state and they insist that they will not do the level of advertising for the job that the perm requires. All in all, he thanked me for consulting him and was done with my case. Im kinda out of ideas. I loved my job and a good at it.

          Hi, did you say you were on H-1B and you were promoted to another position which is higher? If so, did you send a new Form I-129 to USCIS with the necessary revision(s)? Because if not, you might be in violation of the provisions of your nonimmigrant visa, particularly of the Labor Condition Application that was filed along with your petition. Any 'material change' as to designation, duties, and pay package should be brought to the attention of the USCIS as required by the nonimmigrant work status that you have now. This may end up biting you in the future. Anyway, just my thought.

            Rough Neighbor is correct. You must notify USCIS of the change. The "unskilled" or "other" is the lowest priority on the totem pole, so that would not serve you. The PERM is an easy process, the Labor Cert is farily lengthy, then the final process is the greencard itself, which requires the priority date to be current, and then sufficient visa numbers available.
