  • I-751

    I am starting my paperwork to sumbmit my I-751 end of next month. Due to financial strains because of the economic downturn my wife had to move in to Florida and i took a job in Nevada... It concerns me the lack of much paperwork in both our names. I have letters from friends, insurance,lease agreement and utility bills only. would that be enough? any advises??

          Hi Rchianti and welcome,

          How long did you and your wife live together in the same household? You need to have substantial proof to show bonafide marriage. I understand the economy issue, but you guys took drastic measures by living in separate states thousands of miles apart during a crutial time in your immigration process. I can't help but think there is more to your story.

              Thanks for the welcome proudusc. I really appreciated you not jumping in conclusions. I do;however undestand the line of thought expressed by the others and to no blame. If they only knew what we had to go through when we got foreclosed upon. we had to go trough bankrupcy and all that and yes, drastic measures had to be taken.... I met my wife in 2000 and got married in feb 2007. We moved to Nevada and lived together for 11 months and 20 days when the financial roof fell apart. I was "forced" to get a job to build up things again and she went back to her home state, close to her 83 years old mother. C'mom gents I need guidance, not bad comments.

                    Of course the evidence you submit with the 751 will be documentation since your first interview to prove that the marriage lasted 2 years since the first interview

                    It does not sound like the two of you have remained in a viable marriage. It sounds like the marriage is in a seperation process. Is this the case? How long have you lived apart, and is it still an ongoing marriage ?

                      thanks for you reply 4now. We are very much married although being apart for 8 months. We speak to each other everyday. See, it is tough to picture everything. We are not only husband and wife but also best friends. It is just a temporary situation, forced by unforeseen events.

                        I applaud you both on the relationship, but most likely Uscis will not be so supporting I am afraid. It will be viewed as suspicious.

                        You will probably be called for an interview. both will have to attend. You will have to justify the seperation, and hopefully, you have seen her for visits in those 8 months and can prove it. Uscis frowns on this type of thing if it cannot be justified and the physical relationship has to be maintained.

                        Is your residence listed as florida and you are working away from home? this is the way it has to be or vice versa that your residence is nevada and your wife had to leave to care for her mother in florida.

                        Be very careful on this, or you could be looking at a denial. does your wife work in florida?

                          yes she does. We both have residences in florida and I am just leaving to see her. Should I get an attorney to help me with this?

                              Here is your problem,
                              you new when you came to this country,and having too proof later on for your i-751 this will be a big big issue,if you actually live together or not.

                              So I am not sure if this is a fake marriage or not, bottom line is, it does and will look bad for the immigration officer reviewing this case.

                              I mean the number one thing fraudsters do,is live completely somewhere else.
                              I mean living at a different address is already weird, but living in complete different states?

                              U'll have lots of explaining to do when called for the interview,beliieve that.

                              Remember immigration case or normal marriage,if a wife and husband do not live together its weird or something is up.
