  • HELP URGENT, Family PETITION I-130

    I am in the military and am currently deployed to iraq. I have filed the I-130 Petition for my father who is in Haiti. In the petiton is included my father's child who is 13 years old. I have been calling the US Embassy regarding the possibility of having the child coming with my father under the same petition, now iam being informed that he would not be able to come, because of the Visas Type i got, which is an IR5, i am a US Citizen.
    Can you please inform me of anyway i could have my little brother come with my dad under that petition, is there a petition under which he could have immigrated with him, had i known about and filed it.

    I understand if the answer is no, the faster way will be for my dad to file for him, upon his arrival in the US.

    PLEASE Can you let me know how is that works. My hometown is Chandler, Arizona, so i had sent the petition to California.

      The U.S. consulate is right about the ineligibility for your young brother. Your father will get his GC in a few months through your petition. Your father can petition your brother upon receiving his GC. Your brother will be under FB-2A category since he is under 21 years old. The estimated wait time will be around 4-years. the FB2A is moving fast recently, but he still has to wait at least 3-5 years. There is no other way around unless you can manage to get your brother a student visa. I need to remind you that once your father files a petition for your brother, it is difficult to receive any type non-immigration visa for him due to his immigration intent.

        How can i go by getting my little brother a Student Visa? Is it very difficult and how long does it take, how do i go by doing so.

          You have to find a school that can issue I-20 for a foreign student. You have to talk to school's international student advisor in details. I must say that it is not very easy to get a student visa because of your brother's age. Most foreign students are in the pursuit of college degrees in the U.S.
