      My cousin overstayed from april 30 2002, He's going back to his country sept 10 2002. A week ago we went to see a lawyer for information about his overstayed, and the lawyer said don't worry aboutit because the penalty won't be affect after six months overstayed will be 3 years and 0ver a year is 10 years he can't came back in the US. If he leaves 4 months later won't be a penalty? this is the truth?
      Please we need your help ,let us know.Thank you

        That is in fact true as it is the law, but I do not know how the INS officers look at it when he returns for another visit.

          Since he had overstayed he has to face the consequence of that.The only way to know the truth on this matter is when he return at the point of entry here at the US.

            a) If he came on a B-1/B-2 visa, he has to get a new one, old one becomes void with even 1 day overstay.

            b) In he came under VWP, then he will be denied entry, I think he can gain entry if he gets a b-1/b-2, but I am not sure

            I don't know what his chances for a new visa are, probably not good
