labor substitution on which 1-140 was already approved in 1999

    Hi,
    I am planning to substitue a labor on which I-140 was already approved.After that the guy left the company.
    So company says that they can use that labor for me.
    Education and experience matches.
    Company will cancel the previously approved I-140.
    But that labor was approved in 1999 and I-140 was also applied in 1999.
    Now, will the fact that even I-140 was approved in 1999 create any problem for me.
    Is this labor still valid to substitute without any issues ?

      If the I-140 was approved, but never used by the original beneficiary, it is possible to substitute a new beneficiary. If someone already adjusted on the I-140, USCIS would not allow it to be used again.

      As long as you met the labor certification requirements when the application was originally filed, you should be able to go ahead with this.
