  • Misdemeanor yes on DS-156?

Are traffic violations or disturbing the peace (fine of court costs, no sentence) considered 'criminal' offenses and therefore require a yes answer on the DS-156 or other visa applications?

      Benson:
      It all depend. In fact, Traffic violations have 3 categories: 1. Infraction(speeding,running a red light,not stop on stop signs...etc); 2. Misdemeanor(Driving without a licence...etc); 3. Felony(Hit and run, DUI...etc)
It all depend on what traffic violation you are reffering to. You can determine this by the court disposition given to you by the court when you went for the traffic court.

I'm not really sure about the disturbing peace. Again, you can see what this is if you look at the court disposition papers.

When in doubt, consult a lawyer. Would like to make a mistake and end up hiring a lawyer anyway later? or would you like to spend a little cash now just to make sure?

      Good luck!!
