    dear cspa fans,

    easy_cspa mentioned that he has made a letter with regards to a CSPA case of his niece and nephews.

    kindly give me the specific person to whom i should address my letter along with the specific address of the organization in USA.

    NVC---address and contact person for the letter
    DOS---address and contact person for the letter
    INS---address and contact person for the letter
    Senator part of the CSPA committee---Address and his name???

    kindly give me the addresses of these organizations and the contact person. i am writing a letter specifying my case. and if possible whoever has successfully received a reply, kindly give me the format of how u wrote the letter.

    ive contacted the embassy here in Manila, Philippines and they have said that notices have been sent out already by the local consuls. the US embassy operator told me that if i do not receive a notice within the last week of february, i should contact them again.

    but even though, i still would like to make a formal letter to these organizations.

    whats the latest in CSPA?? are the regs coming out soon?????

    easy_cspa i thought u will be sharing some inputs ( eg. format of the letter, the currebt status, etc ).. i would appreciate it very much.

      Hi antman,

      I tried to upload the letters onto this board but could not.

      The letters are in windows word (doc) format. Cut and paste destroyed the formating. So the fax cover sheets I have prepared cannot be used.

      If anyone knows how or where to upload the files it will be great.

        easy cspa thanks for the effort. however, i dunno how to do it. can you just kindly type the address of these organizations and the contact person.. and if it is okay, just the gist or a short summary or background of how you wrote the letter.

        how many months after sending the letter did u get the response.

          yOU CAN CUT AND PASTE AND POST THE LETTERS IN 2 OR 3 CONTINUOUS POSTS. DO NOT WORRY ABOUT FORMATTING. I THINK MOST PEOPLE WANT THE CONTENT, NOT THE FORMATTING.

              ALL,

              If you don't receive any notice from INS or local consul in your country then you are not qualified for CSPA, eventhough you paid for VISA processing.
              Is that true?

                No regulations has yet been issued how to deal with CSPA applicants. If you think, you are eligible under CSPA then you must write letters to NVC, Consulate and INS claiming your eligibility to speed up processing on your file.

                  Hello Everybody,
                  Regarding "Child Status protection act" (CSPA)
                  On "Retention of priorty of date" in F4- F3 categories.
                  Please Read the Two excerpts of CSPA.



                  1) IN GENERAL- For purposes of subsections (a)(2)(A)
                  and (d), a determination of whether an alien satisfies
                  the age requirement in the matter preceding subparagraph
                  (A) of section 101(b)(1) shall be made using--
                  `(A) the age of the alien on the date on which an
                  immigrant visa number becomes available for such
                  alien (or, in the case of subsection (d), the date
                  on which an immigrant visa number became available
                  for the alien's parent)

                  3) RETENTION OF PRIORITY DATE- If the age of an alien
                  is determined under paragraph (1) to be 21 years of age
                  or older for the purposes of subsections (a)(4) and (d),
                  the alien's petition shall automatically be converted to
                  the appropriate category and the alien shall retain the
                  original priority date issued upon receipt of the
                  original petition.



                  So, Subsection (d) means "Derivative beneficiary"
                  Which means Over 21 years children of F3 and F4 and employment based categories.


                  Based on this, "retention of priorty date applies to F4.
                  That means, when priorty date becomes current and the age of the child
                  is more than 21 years after the formula (AGE- I.130 pending period)
                  That child shall will be automatically converted to appropriate category(F2B)
                  and will use his parent priorty date.
                  For this, Child/Parents need not apply for F2B category(Automatically converted)
                  it will be automatic and NOT MECHANICAL(need not apply I-130for child)

                  Now the question is Why Consulate are disagreeing.
                  For this INS has to issue the above same thing as regulation.

                  Please everyone should put PRESSURE on INS and US consulates to know this
                  PROVISON

                  Send as many EMAILS/ FAX/ LETTERS as possible to

                  INS OFFICES,
                  US CONSULATES,
                  SENATORS,
                  REPRESENTATIVES,
                  INS COMMISONER,
                  IMMIGRATION LAWYERS
                  IMMIGRATION WEBSITES(CHAT BOARDS, ANSWER BOARDS)

                  you can use anything from above my meesage to notify everyone.
                  Email address of offices can be obtained from

                  www.travel.state.gov

                  www.ins.gov

                  PLEASE WE WILL DO THE REVOLUTION TO BRING JUSTICE FOR

                  "PARENT-CHILD RELATIONSHIP"

                    Do you beleive that a petition drive can ve more effective for clarity on CSPA ?

                    If so, how many people are willing to come forward and sign the petition. We can probably enlist even people who are not impacted by the CSPA today .

                    Any thoughts from the board participants ( from the usual suspects and not so usual suspects !)

                      How can the INS be pressured to issue the regulations ASAP. that is the question now. bombarded them with letters may be the answer.

                        President BONI and all others,
                        The first thing in "retention" case is
                        to make sure that Consulate and INS are denying
                        Retention of priorty date to childrens.

                        Because people say "Rubbish" in chat board.
                        And we cannot belive them.
                        If you have any honest person with denial in F4(retention)
                        after 6 2002. Then we can fight the case.
                        Is it possible send details of case.

                        Consulate may say tomorrow that, "we have given priorty date
                        to childrerns in f4".
                        Then all our future efforts will be futile.

                        So, How to make sure that, Consulates are denying priorty date
                        to childrens?

                          I agree that there is a lot of extraneous Information(?!) on this board. I have learned to tune out those posts.

                          I think as far as the consulate's denials are concerned, we need the exact language of the denial(if any ) with the relevant sections. Then only can we have a meaningful & logical dialogue on this board regarding the petitions and other proposed action.

                            in fighting for retention of priorty date in f4.
                            if you get any information.
                            pass on, i will do the same.
                            Try to get an offical thing.
                            then it will be meaningful to fight.

                              My case is still with the NVC - so I suppose this is the right time to write to them for my derivative children.

                              Could you let us know the address and exact format of each letter?

                              Also, Can I send you my email address so that you could send it in word file - dont worry about clarity as long as it is readable
