    Hi ,
    I came here on H4 in dec 1999.
    Then one company applied for my H1 visa and I got
    my H1 in May 2001.
    But my employer failed to put me onto the job.
    I mean, I never worked for him.
    Now my husband is filing for his I-485(AOS) and
    I am also applying with him.Though I am not having job,My employer is ready to give the
    employment letter. Is it ok for me to file
    with such a letter?I have not done anything wrong.But I am suffering.My emplyer initially
    told me that he is having lot of contacts and lot
    of things.But coverting my status from H4 to H1
    I came to know all the things.And now I am in trouble.I am out of status
    1> Is it ok to file only with my valid H1?
    'cause I dont want to lie.
    2> Will INS ask for salary slips which I dont have at all?

      You should not lie, just state the facts truthfully that you converted your Visa from H4 to H1 but could not get job.
      You can still apply with your husband for AOS.

        I don't understand why did you switch form H4 to H1 when you knew you not going to work anyways? How about your taxes? Did you pay them?

          You should change your status back to H4 to avoid any problems. Technically, you are currently out of status, because you have not complied with the terms of the H-1. Make sure you have not been present for more than 180 days before you do this.
