    Hi, there,

    I have been working in States for 5 years. I was laid off currently. I am planning to return to home country now. My question is whether I can claim the social security benefit and other benefit like medicare? If yes, how to claim it? Also, can I claim it in my home country?

    I have worked hard in this country and paid tax according to each rule. Now I lost job. I am kicked out by this country like a ball. Do I deserve that?

      No one deserves that. If you earned your wages under your own, valid social security number, there should be no problem. If you were here legally during your employment and paid your taxes, not just the correct amount during the year, and the correct amount at the end of the year, you should be able to file for unemployment and search for other benefits. Good luck with this. I'm sure this has been a hard time for you.

        Hi, Linda,

        Are you sure h-1 B holder can claim SSN benefit? According to INS law, H-1B visa will be expired when H-1B holder got laid off.
        If I claim SSN benefit here, that will mean I am illegal here, can I still get SSN benefit.
        If I claim SSN benefit in my home country, can I get it without my physical staying here?

        Anyone can give your experience? Thank you!

            H1 is a non immigrant visa and you kneww from the very first day if you loose the job you loose the visa also,Why are you crying? you knew all the consequences.why did'nt you file for green card in last five years?
            You can not claim any benefit of SS or medicare
            you can confirm this by calling S S office.
            Go Home and take it easy,you can apply again H1 from your home country after sometime.
