  • For President, Boni and anyone

    Hi,
My parents just emigrate here last month. They don't have their green card yet but they wanted to go back home for awhile because they wanted to sell all thier properties in our country. Can they go home now w/o the green card but had the stamps in thier passport at thier port of Entry?? How Long they can stay abroad??
Hoping for your response soon. Thanks!

Since their passports are stamped, then there will be no problem. Those stamps are as good as Green Card. Your parents should not stay more than 6 months otherwise it will be considered as a break in their residency while applying for Citizenship.

Iwould prepare to have a gc before I go, anyway, it a one month to 5 months waiting. why gamble? And I would prepare to stay away for a maximum of 3 months to avoid the huzzles of being questioned at the port of entry.

It has been suggested by my friend lawyer that a re-entry permit is a must if you will stay away for 6 monhts or more to be sure of safe entry, but then he said there is still a possibility of being questioned.

I agree about the re-entry permit. As far as traveling back to home country for less than 6 months is OK.

I am assuming the objective is to wind up things back home. I am assuming that the intent is to move permanently to USA in the long run.
