  • K3 Visa (The LIFE act doesnt seem to be working)

I filed for a k3 visa for my wife through a lawyer at the end of December last year. I wonder if anybody has any clue as to how long it is taking these days?. I understand that the application travels from Chicago to MSC and then 8 weeks or so to the Consulate and then the Consulate takes another month or so. If the LIFE act was intended to allow families to unite quicker, it really does not seem to be working. Is there some way to find out what the status of a k3 application is and get a feel for how long it will take?

It seems to me K3 Visa is working but taking longer period of time than usual. I applied for my wife in last October and on October 18 INS Chicago office sent me notice of Action and get a timetable of 60 to 180 days. On February 18th, exactly 4 months after acceptance of my application, I got the approval (I got this information in Online case Status checking) from Missouri Service Center and they sent me an approval letter. Unfortunately I did not receive that approval and following letters and my wife did not receive her interview date yet from concerning Embassy. I contacted INS National Customer Service and they informed me that after the approval this type of cases directly moves to respective Embassies and they issues interview date according to their serial and it varies country to country. Some times it takes longer due to FBI background checking and some time for certain embassy's procedural problems or back logs. My colleague got approval 4 days before mine, that was 14th February, and her husband got interview date on 4th March, which is scheduled in April 1st.

In any way it is working and working within the given INS time frame.

        Dear Saleem,

Thanks for your encouraging reply about the K3 schedules. I hope it works out the way you describe it. I guess there is not much control over embassy delays.
