  • Unused labor certification

One company company has two unused permanent labor certification. Can they be used for the other beneficiary?
How about ability to pay a prevailing wage for the new alien? Will it be checked since beginning of LC or since AOS is filed with BCIS for a new alien?

The company showed loss on its corporate tax returns in 2002. How will the ability to pay be checked for the new beneficiaries of those unused labor certifications?

Yes, they can use the LC for another employee, it's called substitution of beneficiary. If your company has financial troubles, they should show that they covered their payroll in 2002 and use projected financials for 2003 and 2004.
