  • need help here, thank you,

Is it true that all the time you have spent in the states and be divided by half and rolled into the total time for applying for the citizenship? I just got my green card last week. I have stayed in the US. for 7 yrs total as H1 for 5 yrs and holding the "Status of Adjustment" for 2 yrs. In my case, I can calculate my time to be in the states for 3.5 year already for applying the US. citizenship!!
    thank you very much.

First off, I'd like to congratulate you.
A milestone over for ya. Now you can breath the air of liberty.
However, I am not too good at this whole immigration thingy so I cannot really answer ya, but I am sure a good soul here will help you with that.

I have a question for you though, How was your interview?
What kind of questions they asked you?

        Again, Congratulations.

Never heard of counting the year before GC when determining eligibility to apply for naturalization (USC).

According to USCIS, it'll take 5 years for GC holder (3yr for marriage based GC) before they can apply for naturalization. This provided that within that 5yr period they've never been out of the US for more than 1 year, and has resides in the US for a minimum of 30months. An absence of 6months or more but less than years will disrupt the 5yr period (start all over again) unless waiver is obtained or there're other evidences to show that the residency hasn't been abandoned.

You are here in the US for the last 7 years.
5 years as H-1, 2 years as holding on for AOS.
It took 2 years to get your GC. Your file was
lying in the Cold storage for two years.
This law is quite clear that you need 4 1/2
years residecy to file for your citizenship.
By the time your are called for Oath of
Citizenship, it will be more then five years.
To transmit the citizenship to a child born in
foreign Country you can count all 7 years time.
since you arrived in the US Legal or illegal.
But for your citizenship, you must have entered on Immigration visa. But in your case you were here as temprory worker, then you file for adjustment of your states, BCIS was kind enough to grant you the GC. According to the law, Once the contact is over the company should, make arrangement for the travel of the H-1 applicants. Nor the Company or the BCIS/INS, would like to work and enforce the laws with the company. I don't think you like this answer. This is the law, the way I read let see what others have to say, I might be worng, but that was the asn I received from Govt. Agency, some time back. Your time starts from GC. for your citizenship. Best of Luck.
