The company I work for has advised some of its staff including myself that due to economic problems we will be terminated as of November 15th 2003..as one of the benefit the HR person told us that we could collect unemployment. How is this going to affect my AOS application? and also as an individual on AOS working with a work permit, am i entitled to unemployment benefits?
Thanks a lot for your inputs......

It shouldn't affect your AOS, and I do not think that you should have problems claimaing unemployment, as long as you have been contributing to state unemployment.

Hi. I am assuming your AOS is based on a application by USC spouse by way of I130/I485.


If so, this will have no effect on pending AOS status. However. if you will be eligible for unemployment benefits will be determined by the length of work and how much $$ in a required amount of previous quarters worked. You may not be eligible if there is not sufficient work history established to meet those requirements.

if you have unrestricted rights to work for anyone (ie: at least an EAD) -- then yes you can file for UI. It's your right.
