Hi, My EAD was filed last April 11 to the District Office. AOS was supposed to be filed on April 24 before the Immigration Judge but it was put off. So the District Office forwarded the EAD to Nebraska Service Center.
AOS was finally filed before the judge on July 11 and I got the recepit number for the EAD. I checked the case status online, here is what I get;
"On July 10, 2003, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed. If you have questions about the notice, what is required, or if 14 days have passed and you have not received the notice. Please contact the service center where you submitted your application during business hours."
I didn't get anything in the mail, and I don't know if my attorney did. What kind of evidence would they be asking? What happens after submitting the evidence? Am I going to get an appointment date at the Service Center?
Wait another 4 to 5 days and if you don't get anything, call BCIS. Check with your lawyer first.
Just wait what RFE they need, you won't know until the mail arrive. Don't worry too much, they might need additional information or updated info from you. So sit tight.

One more thing, make sure you provide them with the evidence they need as soon as possible and they will change the online status when they received and approved your RFE. Do not delay the submission of RFE coz' it might delay your case.
I called my lawyer's office and asked about the letter, the secretary found it and put it on his desk, anyway, she said that they want 2 color photos and etc. on the letter... What for?
Did you submit photos with your EAD application? You have to attach 2 ADIT style photos with your EAD application. Don't you lawyer know about this? What are they doing? See...now because of the photos, your approval of EAD delay, at least for 2 weeks.
This RFE only for EAD application right?

What do you mean they need other additional documents? For EAD application you only need to submit copy of I-94 form and 2 ADIT photos style and of course the fees.
No I didn't submit anything along the EAD app. and I am sure my attorney knows the requirements. As I wrote in the original message, the problem was this, my attorney thought that the District Office would take care of it and they would send an appointment letter and I would take care of the stuff at that time. But instead of DO, the application was forwarded to the Service Center, and they don't know anything about the case, that is why they must be asking more information. My AOS is not with the Service Center either. Fees are paid, I don't have an I-94. 2 weeks at best is great if you ask me, even a month is OK.
Hmmm...thats strange, your attorney should ask you whatever documents needed to attach to your application. Now I wonder how your AOS forms standing. Do they submit all necessary documents with it too? If you don't have enough documents with it, it will delay and BCIS will keep sending you RFE every time they need something. If you're okay with it, thats fine. But I hope what you pay to your attorney is worth it for your time and money. Not every attorney are experts in immigration stuff, some of them even made problems and screw things up. Anyway if you're okay and think there will be no problem, thats good. :)
Yep no worries about the AOS, because it is filed with the judge and before filing, the judge has to make sure everything is right, so since she accpeted it and it is filed, they are OK.
In court-AOS cases, every district has a different procedure as far as I see, my lawyer told me that in his area, usually the DO takes care of the EAD but here they sent it to Service Center. If we knew it was going to the service center we would have provided the photos and whatever else they need. So I am going to get those photos done and send it to my lawyer and he can submit them to SC. I don't how long it will take after that.
Well, I had my lawyer to fax the RFE letter. He faxed it to my friend's fax and I didn't read it yet, so far, my friend tells me that it is photos and a Photo ID they want... Thanks for your help. I'll be in touch...
If you are mailing your application to the INS, you must also submit:
2 photos with a white background taken no earlier than 30 days before submission to the INS. They should be unmounted, glossy, and unretouched. The photos should show a three-quarter front profile of the right side of your face, with your right ear visible. Your head should be bare unless you are wearing a headdress as required by a religious order to which you belong. The photo should not be larger than 1½ X 1 ½ inches, with the distance from the top of the head to just below the chin about 1 1/4 inches. Lightly print your name and your A#, if known, on the back of each photo with a pencil.

Yep Bushmaster...its call ADIT picture. Josephine, I read about your hubby's SS# application, its almost 2 months...erkkkk....now I hope mine not taking that long. Hopefully BCIS update my data in the SAVE system as soon as they give me the EAD.

Hubby got his SS# July 10th.
He was supposed to get paid today.
I had his A# on job application. Got SS#, put SS# on W-4. The idiots at his payroll didn't cut him a check. His SS# was on the W-4, which is what they are supposed to use for payroll input. What incompetant morons!
