Hi, Freedom1. My interview was today. Piece of cake. Took about 5 minutes. About 10 civics questions, write one sentence "The White House has a big tree." and read one sentence as well.
He also check the dates of my trip, my medical exam. I passed the test but he said he couldn't give me the answer about the aproval or not, that he will send my case back to National Benefits Center and I would receive the answer from them. The only thing that bothers me is that he said that the 19 months period starts from the date of aproval of my temporary residency. Hopefully I will have any news soon.

What trip?
A trip that you took after you became temporary resident?

Or the trip/s you took while you were here without status?

I traveled abroad twice after I became temporary resident, he wanted to make sure that I didn't brake my temporary status. And yes they are not reading the law correctly.
How about you? Any news?

I see.
Me, I'm waiting. My lawyer found out about my case. The adjucator said my application can not be adjucated until the 19 month from my elegibility date. So they're not following their own laws. My elegibility date is coming up in about 3 months or so.

I checked my case status online today:
Current Status: approval notice sent. On May 12 we mailed you a notice that we have approved this I698. Please follow any instructions on the notice.
I will double check my mailbox everyday from now on.

forgive me if i sound foolish.. but whats the difference between I-698 and I-751? Arent they both going from temporary/conditional to permanent residence?

Nothing foolish about your question. I-698 is a form to apply for change of status from temporary residence to permanent residence based on Legalization/Late Amnesty cases, also known as CSS/LULAC cases. Nothing to do with form I-751, which is based on marriage. Feel free to ask any questions you may have.

Hi hjv,

Any update on your case yet, I still haven't filed my I-698, the $1500 bucks is staring me in the eye each time!!! Anways I have time, they won't move my case until June of '09 anyway b/c that's when it will become 19 months for me at that time. Nevertheless, I'll probably drop it in the mail one of these days to get it over with.

I just went to the local USCIS office last Friday (INFOPASS appointment) to ask about the status of my case. I was given a letter stating that I will receive an appointment for interview notice next month. I was affraid that I would have to apply again, this time paying the full 1,400+ dlls. Now I just have to wait for that letter, but at least I know now what to expect.

I got my card today, but my date of birth is wrong. I called the USCIS and now I have to file a I-90 and send my card back to get it fixed. They said it might take 180 days to get the new card. What a nightmare.

180 days? What a bunch of incompetent people!

When I called the customer service a very rude lady (first time) told me that I have send proof that it was a USCIS mistake, not mine. She asked me if I have a copy of the first I-90 that proves that was not my mistake. The problem is that I never filled up an I-90, I believe it was the immigration officer who did. So now I really don't know if I should send the fee or not.

YES, it is a nightmare of some sort.

Before you RETURN that green card, make a photo copy and keep that.

Go to USCIS site and PRINT the I90 form. If you are NOT paying and you DON'T have to if its their mistake---PRINT FORM fill in and also send in proof (like your Driver's license and birth certificate from your home country), include a letter to say they have your birthday wrong and that you are sending back the card and proof of DOB. Again, keep a copy of everything you send in. BE SURE TO SEND IT CERTIFIED WITH RETURN SIGNATURE CARD.

That way, you have proof that you sent it and they signed for it---otherwise they may come back and say you never did sent it in.

YES, the wait can be as long as 6 months or longer. If you are lucky, may be faster.

In my case, I never even got the original card (never saw it, never got the welcome letter either)and I never moved in the last 10 years. Then they told me--- they sent it and I needed to pay. So for me, I had to pay $370 (including biometric) and am still waiting.

Hey Freedom1, I'm going to apply my I-698 pretty soon. My eligibility will come May 2009. I traveled abroad in March for a week and on the way back as ussuall had to go through the extra scrutiny and questions and all that. Question is, if I apply now and list my 1 week trip and then later on travel again, what do I do in that case. Do I just wait for the interview and update the officer then about my additional travels. Also, on my way back the custom officer told me I should have a stamp in my passport that says temporary resident. He told me I need to go to the immigration office to get it. I recall when i had my interview the officer said he couldn't give me such a stamp? Did you guys get anything of that nature and were you asked the same question when you came back from your travels?

Hi Shabber,

Yes, when you file your I-698, just enter the March date, then during your interview, tell the officer that you travel again and update him/her with the dates. This is what my lawyer told me to do.
My eligibility date is coming next month!
We'll see how long does the USCIS takes to call me.

Also, a lot of officer at the POE never have seen our "temporary residency" papers, so they have no idea how we got them. Also, some officers confuse our temp residency as one of those conditional perm residencies that you get when you merry an USA citizen. This is why they asked you to have your passport stamped. But the USCIS doesn't do that in our cases.

I have traveled abroad several times already without any problems.

Hey RRM, just a quick question, when you got your green card was it dated back to the date of your work permit (temporary residency card) or was it a new date close to your interview.
