Write to USCIS and tell them you wish to withdraw your sponsorship. Cite the dates he moved in and moved out. If you have evidence to show he scammed you to be with someone else, include it.

Surely Sonya you know what to do by now. Is this your 2nd, or 3rd husband? and you want to marry again, acccording to a previous post.
It is very strange how they all leave you in 3 yrs and from another country. hmmm And they even get remarried and bring a new wife back here. All so strange.
My advice, stop jumping into marriage too quickly.

Sonya you should not file for a divorce but an annullment based on marriage fraud. You will do much better and hopefully bar him from doing this to someone else.

Davdah USCIS wil not consider an afidavit from a US Citizen to be sufficient. An annullment is needed to create an official record.

It may not complete the job but will at least perk up their attention due to the short amount of time he stayed with you.
Be specific about the dates he moved in and back out. If you have the address he moved to, provide it, along with anything you have to confirm it. More than likely he did not file a change of address as is required by intending immigrants within 30 days. He would have done this to avoid suspicion based on his short stay with you.
In your letter avoid the 'drama'. They don't want to read about how bad it made you feel or how many nights you cried yourself to sleep. Keep it to the facts and preface it with language stating you believe he married you solely for immigration benefit.
If possible, ammend your divorce petition to include fraud if you filed it already. If you haven't filed it, try for annulment based on fraud instead.

Sonya, you said in a post not long ago that he went back to his country?
Is he still there or back here? Did he stay any length of time in this country since marriage?
If he stayed or stays out for long period of time, he could lose his green card anyways or will find it hard to get permanent card at this rate.
