Kollerkrot,

Within the immigration cases of Lennon and Mc Cartney you may find the answers you need. Your case may be more similar to Mc Cartney’s than Lennon’s.

As ProudUSC says, Mc Cartney was caught with drugs in Japan, and was deported. This meant the incident was known to the US Government, yet Mc Cartney suffered no known US immigration consequences.



The only thing un-American about America, is the USCIS.

Another difference between the McCartney/Lennon cases is, to my knowledge, McCartney never sought permanent residency in the U.S. and Lennon did (which he eventually gained).

Both these cases are fascinating. Lennon was given extra grief because Nixon personally disliked him, and tried to thwart his US immigration. Mc Cartney must have been given preferential treatment. In general, if the US Government is aware of a drug related charge, the alien is deemed inadmissible.



The only thing un-American about America, is the USCIS.

Good stuff Koller. If he takes it on, the USCIS is toast. Might cost ya some major $$$ though I'd guess. You have a good case for a "re-trial" after all these years and it's a bit unusual.

He asked me for a stiffer than usual evaluation fee, but I asked for pro bono. If he does take it pro bono, it doesn't cost me any or very little. I am not rich, but, the publicity would be substantial for the firm.

I am gonna have to bring this up one more time! Please bear with me! I don't seem to quite understand what "knowledge irrelevant" really means.

Here is what I think:
If a court convicts without establishing guilt - that would mean "making knowledge irrelevant". Do I have that right? Lennon plead guilty and later on claimed irrelevence..........I'm confuse!
