This is the latest information, I called the court phone #, and they don’t have any information. I entered the A# tells me that they don’t have the A # in the system. The guy how talked to us yesterday (he was with my cousin at the detention center in Euless, Texas) told us that my cousin showed him a paper with 2 charges of smuggling, a fine of $5,000 (everyone there had the same bond) and it didn’t have a hearing date. We don’t know why he has the charges. Also, we just find out that he has a court date on Jan. 16 for a DWI charge (we were not aware of this either). We are trying to figure out what to do. First, if we pay the bond and he gets detain for the DWI charge and he doesn’t show to the immigration hearing would we lose the bond money? Or if he is detained for the DWI would they allow him to go to the immigration hearing? If these smuggling charges are true is anything that we can do so he doesn’t lose his residency? I was reading something about you can appeal a removal or deportation if you’re being a resident for more than 5 years, continuous residency for more than 7 years and you don’t have an aggravated felony. Like I said before my cousin has not talked to us yet and all these facts we got them from different people and research. Hey, thank you for all the information. We really appreciated it.

ggfrisco if he doesn't show for his immigration hearing he can also be deported and you bond money will be forfieted.

If he gets detain for his DWI would they let him show to his immigration hearing?

If he is facing smuggling charges would he be deported? Would he lose his residency?

Hi Mike, the info that we have is the following: He is being charged with smuggling. His charges are Section 237(a)(1)(e)(i);237(a)(1)(a);212(a)(6)(e)(i). This violation was committed on 2001. I looked up the charges and I am trying to figure out about the 5 years on the first charge because this happened more than 5 years ago. If someone has any information that it will help I’ll appreciated. Mike thank you for asking. By the way I like the cat too.

He stills in custody because he doesn't have a bond. First they gave him one and later they took it away.

ggfrisco ..if they gived him a bond and later they took it away then this is not good ... what happened is ,they gived him a bond first bcoz he wasn't an arrival alien..but later when they digged and they saw those charges and finds ot more things about him ..they knew it was risky to give him a bond bcoz he's a ( flight risk) and thats why the bond was taking away ....the only obtion for himis to proov that he didnt do it...and if he can then he will be able to keep his ststus and jst go home,,,if not,,then he will be deported,,bcoz this is really serious..it's not like a traffic ticket and thats it ..smuggling is a bad thing my friend ..just go to the attorney ,,and make sure to find someone who can handle immigration criminal law..not just immigration...and tell them what u just told s ,and c what they tell u ..good luck

Prisoners do not have any right to use a telephone. Why should Americans pay someone's phone calls? He only has the right to call his attorney if it is a criminal matter and then only to his attorney. If it is an administrative (immigration) matter, he does not even have this privilege.

lol..dont insult my cat ...well 1- the immigration doesn't pay for ther phone calles and they never did..the detainees buy's phone cards in the detention and thats how they make the calls if they dont wanna call collect..they pay for the phone calls,there is no free calls .2- the'r detainees ,not prisoners.3- this is the story that his cusin have told them,,it's not his fault and he know's it doesn't make sence and we said it long time ago..but yea..his case is gettinf more complicated ..he's a flight risk now and he cann't get a bond unless if they put down a house or something ..i dont c any legal ways for a relief from that charge unless if he didnt do it ..
