Yeah he's surpose to have access to a phone but you know with ICE they do what they want.

We didn't call the phone # because we didn't have his A#, finally one of his brothers find a spared key for his house where he has his green card. I am waiting for them to call me with the number or more info.

I have to jump in here. Initially ICE will recommend a bond amount. In this case its $5k. But it won't be until the bond hearing that the bond will actually be set. Usually the bond hearing and arraignment are done simultaneously. More than likely the bond will stay at the recommended 5k amount.

You will need to show he is not a flight risk in order to get the bond approved. Losing the job is a big strike against him. You may want to contact his employer and explain the situation and see if he can get his job back. At the bond hearing bring things to show stability. Pay stubs, rental agreement, children's report cards from school. Basically things that show he will stick around for the legal process and not disappear. The Gov attorney will argue that the bond should not be granted. It is your job to show he will stay for the trial if released.

The bond itself will need to be cash or equivalent. A bondsman can be used but it will cost around 20%, 1000.00 It will need to be secured by collateral. Usually real estate is required. Not a lot of bail bondsman deal with immigration bonds because they are considered very high risk.

You should be able to find out the appearance date & time for the arraignment and bond hearing from the detention center.

Something else. You should ask him point blank if he did what he is accused of. If he did then you should start thinking about what to do with his son.

u may be right davdah ,,but let me tell u this,,,they r 2 different things,,the judge can give u a bill and this only can happen at the first court(bill hearing)but ICE can give u a bond before and after the court,,it happened alot were the immigration judge denied the bilL at the court and the same ppl were released on ICE bond,,and actually even if the judge gives u a bill ,ICE can still keep u in custody ,,i know a guy who was granted a bill from the immigration judge and at his second court they took him to custody again,,,but if he can get a bond from ICE..it's alot better than the 1 the judge can give u ..ij can give a bill for only non arrival aliens ..he doesnt have the authoroty to give bill fr arrival aliens..so if he's getting a bond before his court day,,then ICE are the ones who gived it to him and not the mmigration judge

I think there is some confusion here. An immigration judge can decide on bail for immigration related issues. If an immigrant is held on both immigration and criminal charges they may end up with two bonds needing to be posted. One for each. Your friend who ended up being remanded back into custody was probably unable to get bail set for the criminal count even though he could for immigration. ICE can only recommend an amount. The judge has final say if it is accepted, or adjusted up/down. If the judge orders bail set and it is only an immigration charge the person must be released once bond is posted. Regardless if ICE protests.

maybe ur right about him,,but iam positive about that,,the immigration judge can give u a bill ,,but ICE can give u a bond even if the judge denied ur bill...there is alot of ppl were caught at the boarder,,and thoes ppl cann't get a bill,,the judge doesn't have the authoroty to give them bill even if he want's to,,but ICE can give them bond,,,i was told by immigration judge to try them,,,bcoz he didnt have the authoroty to give me one even though my record is clean,,bcoz i come from the border..and he said,,they can,,,try with them,,and they did start the process but we screwed at the end when my stupid former attorney didnt provide the address..but they told me yes,,it's ganna be 30.000 and the judge has nothing to do with it

the judge can decide the bill at the first court only,,after that,,he has nothing to do with it....

The master calendar hearing and the bond hearing are two different hearings sometimes a lawyer can ask for a bond hearing before the master calendar just to get his client out of detention.

Davdah, i've seen where ICE gave a guy a bond and his family came and paid it right where he was held in Jacksonville,Fl and they released him so sometimes the Judge doesn't get involve,now he will then have to go to court after to answer the charges.

Mike youre right,i remember a guy who was in detention was coming back from mexico he was a PR and he told us that he didnt get bail because he said the Judge could not give it to him and the told him he didnt have the authority he was an arriving alien.

thats true,,the judge cann't ,but they can release him...but if he was caught inside the country,,the judge can give him a bill..and usually it's $500-$1500... i dont understand why..i mean getting caught at the border or inside is the same thing ..if ur illegal ,then ur illegal,,doesnt matter where u get caught ,,and then think about it ,,the judge is not the one who put's in there,, they r the ones..so they can keep u in there as long as they want ,and they can release u the next morning if they want to

Did a little research. It seems ICE can grant a bond and the person can be released prior to a court appearance. Kind of makes sense since the process is technically a civil issue. The judge would be called in if the bond determination by ICE is disputed by the detainee. It may vary by jurisdiction how they typically handle the cases too. If ICE has an agreement with the judges that they can make bond determinations prior to appearances then it would fly. Kind of dangerous since a person could slip through the cracks and get out prior to discovering more serious offenses.
