Hello, my cousin is a legal resident. He is being a resident for more than 15 years. He had some tickets and when to jail to pay the tickets with time (he wanted to save some money). After being in jail for 4 days they sent him to an immigration jail (homeland security). The reason was that he did not have his green card with him and they wanted to make sure that he was a legal allien. After two days of interrogation without an attorney he called us today and he said that they are charging him with smuggling an ilegal allien (he has never done this). Also they told him that is time for him to find an attorney. Could someone help us? Could they deport him? We are in Dallas, Texas. All this happend last Friday
,,smuggling an illegal alien???? hmm,well,,if he have done this,,then yes,,they can deport him ,,but the question is,,why would they mention this anyway? it has to be something and maybe u dont know about it.. i mean ,,uscis always accused ppl of getting married just for the green card,,but this is something different and it's serious my friend,,,he needs an attorney as soon as possible ...this is all i can tell u

and make sure to call him and leave him a msg to call u from the detention center,,he can make up to 2 calls per day while he's in custody,,and tell him not to sighn any documents no matter what,,ok,,no matter what it is,,not to sighn anythng,even if it's a release document,,hire an attorney now ...they deliver msgs to the detenees at the detention center,,dont forget,if he sighn something thy can screw him and get him deported even if he hire an atorney later on..

and not to make any statments to them ,,any statment he makes right now will be used againts him when he c the judge,,ok and i have seen this before ,believe me,,they trick ppl something,were they tell them,,ur n trouble and ths and that and u will be in prison for 5 or 10 years but we can make it easier for u if u sighn the deportation document and sometimes it's all lies...not to sighn anything,,and not to make any statment ..good luck

They already try to make him sign but he did not want to sing anything. He asked to see a judge. When he called us he had less than a minute to talk to us and he did not have time to tell us where he was or the phone number where we can reach him. Also, we can heard in the background somebody yieling at him asking him to hang up the phone. We don't have idea where to call. The only thing he said was that he needed it an attorney. We are trying to call a 1800# for Homeland Security but we cannot speak to anyone. Do you have any ideas where to look for a phone number?

He will have access to phones in the detention center. He will probably call you after he is processed in. Any outbound calls he makes will be collect. If you want to talk to him make sure you don't have collect calls blocked on your phone. If he was charged with smuggling (aka coyote) then his chances are dismal. More than likely what he did was give someone a ride who was an illegal. That is all it takes.

thats true davdah,,but sometimes they dont let them make calls at all,,,specially if he is in an individual room prison cell..which i assume he's ..bcoz of that charge they brought againts him and bcoz he said he heared the CO yelling at him ..only general pop have access to phones all the time ..but not those guys .

thats true explora ,but the easiest and fastest way is to call the immigration court system and tun his A#..and listen ggfrisco,,u said he asked to c the judge,,he cann't request to c the judge,,he cann't c anyone other than his deportation oficer,,he will c the judge at the first court(bill hearing) when they get his file ready ,,but it's not up to him,,sometimes lawyers can speed this up..and this is why he needs an attorney

Even the orange shirts have access to phones. He's still considered a low level threat so it won't be much of an issue. He'll be able to call soon enough. It may take a while before he's settled in. They usually have restrictions on the time of day when he can make calls. Usually no later than 10:00. The account with the phone pirates will need to be set up soon after he calls the first few times. Have a credit card handy for that.
If you don't hear from him by the next day call the local USCIS office and the immigration jails. Have is 'A' number handy for reference. Visitation is usually restricted to week ends only and during certain times. You will need to be cleared before hand. You should ask about that when you call. Each facility has its own requirements and restrictions.
