My wife made a false claim of citizenship at the port of San Ysidro, CA in 1999. She is not eligible for a waiver and is inadmissable to come to the US. Her INS file was in Juarez with the documentations and now I have to move to Mex. If anyone has any advice for me I would greatly appreciate it thank you

as you discovered, there is NO waiver for 212 6C(ii).

Sorry about your story. I say do you what you need to do. As you said yourself, there is no waiver for this ground therefore No solution at all. Good luck with your new life in Mex.

212(a)(6)(c)(ii) makes her inadmissible for only 5 years which will go by fast.

an ineligibility under this section of law is a PERMANENT one - it expires when the person is 90; it does NOT 'go away" after 5 years. Reread the Immigration & Nationality Act under this section.

hi they deported me 2 years ago my wife puerto ricon american but law say no waiver for 212(a)(6)(C)(ii) but why l didnt do any wrong thing just in border show show my american ID and l havent speak english and officers pushed me sign paper and deported me now they say no waiver but my wife in there and she is american US citizen she doesnt have any rights? what kind off human rights? and why they sperated family Im not drug dealer not killer not mafia not terrorist Im clean person and want live with my wife we just came this world one time why they make our life like hell who wants to live sperated of family I want all guys here who spouse parents get deported and NO waiver grounds please be together and go congress and change that racist rules please we just want to be together us family thats all good luck everybody

"false claim to U.S. citizenship" is a federal felony (most felonies are automatically aggravated felonies for immigration purposes) and make the offender permanently inadmissiable and permanently ineligable to adjust status.

These are the laws at the present time and I don't think they'll change any time soon because the most fundamental trust of someone not lying is being broken which makes the contract between a foreign national and the U.S. government impossible!

If you do make a false claim of being an American Citizen and you knowingly did it..........you should NEVER be allowed to come back. Shame on you !

If you don't want to be apart, have the USC move to your country PERIOD

Cuz after 10 mins of VIGOROUS questioning -- 99% of them give up and admit they aren't. Smile

it's like one of those FBI interogation bad cop/good cop things in the movies. hehe.

Have you found a solution yet? I'm in the same situation, except the border patrol agent lied about everything. I walked across Laredo border with a USC friend for a few hours. On the way back I was charged with False Claim, and they sent me back to Mexico.

A few weeks later after getting impatient with the attorneys, my wife came and got me. We were inspected on the way back, and our car was even searched. They let us through. Then I went to finger printing deal (my attorneys office told me to go ahead and go). This was another mistake because now there is a record of me being in the US when I'm not supposed to.

I got a letter later that my case was closed and to turn in my EID card.

We've consulted many attorneys last year. They've pretty much told me that I'm in a GREY area. I wasn't deported....but yet I'm not legal and here. My file has been merely tucked on a shelf collecting dust so to speak. We've also contacted our reps but they said the case was Federal, and that it has to be taken into court.

Well, I never took that risk since it will turn into the cops word + whatever I signed VS me and my friend's statement. I would have most likely lost that and then retained/deported. So I never went to court to fight it.

It's always one mess after another. Wish I had a bazillion dollars at that time.
Yes, I should have known better. It was ignorant on my part to leave the country not knowing the consequences. No need to lecture me. If you don't have any useful advice, then please move on to another post. FYI, we got divorced a while later (she was cheating on me).

That was another mistake (to divorce) because I could have filed under another part of 245i (IIRC) which was for immigrants coming to the US illegally (now I had entered illegally since there are no border records showing I was inspected). We never had kids. I entered the US legally when I first came here.

My folks hold GC's and soon to be Citizens. My sister is a USC along with her husband and kids. I'm nowhere. The peachiness of life is not so sweet.

I hope they change the law someday soon. Seriously, I could have killed someone, and still I wouldn't have been permanently banned. This is just rediculous. Whatever happened to being innocent until proven guilty?

Advice for living in Mexico:

1. Don't drink the water
2. Don't pay more than $2.00 for a hooker
3. Keep the chickens and stray dogs from your hut
4. Make sure your 17 year old wife works while you siesta (it's the macho thing to do)
5. Don't ever bother seeing a dentist again and if you do, get a big gold filling on a front tooth
6. Get used to driving a 20 year old car
7. You won't ever bother with Taco Bell again
8. You can't get good Chinese food ANYWHERE in Mexico
9. Tequila - lots of it
10. Corona - lots of it

Hasta La Vista Amigo !!!!

First off: ignore Michael's, the "compatriote Republicans" comments!

Secondly; contest BCIS practice of luring innocent aliens into 'lying' about their status. They will ask as long as it takes for someone to make that natural mistake. Taken, that it indeed was a mistake, but it's also common knowledge that the border neo-nazis and neo-cons have a well established history of pychologically (and many time violating American democratic values) luring people into making false statements.

I was at the border town and it ****ed there. Coronas were definitely popular and man, the water was something else....

But i here the further down into mexico you go the better it gets.

anyhow, it's the poor and the rich there....not much of a middle class that i saw. everyone is trying to make a quick buck. it's also LOUD as hell there. **** shops with big speakers outside playing random music.
