Does any one know the out come of this class action suit filed by ACLU vs. FBI & USCIS on Dec 4, 2007 - Southern California? ... All plantifs were N400 applicants, waiting and waiting pending FBI name checks. Some of the plaintifs had their interviews, and some did not. I can not find the outcome. Does any one know if it was favourable or not?
My boy friend will have to go back to Australia this week because I cant get this darn citizenship. Its just destroying lives.

I remember hearing about that ACLU one but I dunno what the outcome was. There was a favorable outcome for that PA class action lawsuit earlier this year though.

Carribean man... He is here to be with me, we planned to marry as soon as I got my US Citizenship... However, delay delay delay. And he has been here since August 4th,2007.. Like a good person, not working, not violating any laws... But this can not go on indefinitely. He took a years leave of absence from his job in Australia, just in case.. Good thing...So... He feels under the circumstances, that he cant work, and USCIS & FBI could give a &^%^, therfore the possiblitly of working any time soon is about zero, he has to go back. It has caused a great deal of tension between us.

I just read about the favourable case of n400 delays ... now i just have to find a good attorney to sue for us... and that wont break the bank... hahaha...

From my understanding, the lawsuit has been filed, but no trial, no decision, no news. It is going through the process.

Under current federal law, there is no timeline for name checks. And USCSI name checks are on the biottom of the list of priorities for the FBI. But blame Congress, They are the ones who set it up.

This is the price law abiding people pay while Illegals receive heavenly treatment. It is unfortunate that in our own country law abiding citizens/immigrants are tortured in the bureaucratic process; however, illegals can simply live, abuse, cheat the system and they are given Greencard and citizenship on a golden platter. I heard recently from a reliable source in my area that the USCIS allow 2 namecheck expedites a month. So it's like a raffle for who gets the most deserving case. If you have some kind of special reason why it needs to be expedited, that may help. I doubt that it would be enough on it's own for you marrying your bf so he can stay to be enough of a reason. Have you had the Citz interview already?

I've been waiting nearly 2yrs for the namecheck to clear on my N-400 and apparently, that's not a long enough wait. 3-4yrs is a more likely timeframe to act using a Writ of Mandamus. The recent notification on the USCIS website about namecheck backlog elimnination plan is only for PRs and not Citz apps.

No citizenship interview yet.
But in the St. Petersburg Times newspaper yesterday there was an article about a local attorney preparing a Class Action Law Suit here in Tampa. I called his office. I hear on a messge from him this afternoon that I need to have had my interview already. So I guess that takes me out of his realm of help at this time. I did go to see my local congressman yesterday. His helper called me this morning to tell me he called the USCIS already, and he just wanted some more info before he called the FBI. I am liking that. I will see if anything developes from that.

Attorney Arturo Rios Jr. 727 321 8151, St. Petersburg. However, I have since learned he is only taking people who have had their interview. I have not.
But.
I contacted my local congressman. Went there two days ago. By the next morning he had called USCIS and FBI. He called me back late yesterday afternoon to confirm that indeed the FBI has cleared my name check and it is now waiting for USCIS to update their bank of information. (previously, some one told me my name check was cleared by FBI on 3/21/08).
Unfortunatly, congressman's assistant could not tell me how much longer I would have to wait to get my letter/call for interview.
So, it's good news, and no news... So, we wait some more.

I found your post in the other thread and referenced the above one. More concern here for me is this question.

Is your boyfriend still legal and not accumulated any unlegal presence? If he is an overstay, it is not wise to let him leave as he will incur the bar.

BTW, according to your post, you did plan to circumvent current immigration procedures by planning.. I emphasize planning to marry. Proper procedure would be filing K-1 once he returns to homeland and you bcome naturalized.

I believe that Austraila has VWP, or was he here on a special visa that allowed him to stay for more than 6 months?

you will now need to be very careful about fraud intent, if he came on vwp and the adjustment of status would be denied. There would be no appeal, and the decision would be final.

Immigration is not giving any interviews now until the background check has cleared. So no lawsuit may be pursued because the 90 clock has not started until you have an interview,thats what I read anyway.
There swamped right now so its just going to take a long time to get citizenship. I have read no where right now being May 2008 that ANYONE has gotten there citizenship under 1 year or a little more.
Guess we just have to be patient.
